The statement was never that the Desire couldn't run Gingerbread. HTC's problem was that they couldn't fit both Gingerbread and HTC Sense into the Desire's limited ROM space.

Chances are if you are running a rooted Desire and you really wanted Gingerbread on it, you already installed a custom ROM running gingerbread...

Dr. Pepper Co. is just stupid to try to pursue a lawsuit like this. A Dr. Pepper plant can only control which retailers it delivers its product to. That chart is based on revenue and not actual market share. All it proves is that iOS customers earn slightly more money for Apple than Android customers earn for Google and its partners.
