There have been two referrals to the ICC since the Rome Statute entered into force, in 2002- Darfur (GWB); and 2010- Libya (Obama). Under GWB, the US abstained and so did China. That they didn’t veto the referral was considered a huge victory. For Libya, both the US and China voted for the referral.
