I was a 2002 beta tester for the original Xbox Live.

The difference between MW3 and BF3 is sorta like the difference between a game running on Xbox 1 versus the same game running on Xbox 360.

This ban is an Activision ban, not an Xbox Live ban. They will unban you in time to play with everyone else on launch day.

The gameplay mechanic could possibly be the ability to stop your swing mid-air and attach yourself to the nearest object (while still being well animated).

This won't end well.
