As trollish as this comment sounds, I have to agree. I don't think the 360 experience has been enhanced at all by the Kinect and I could care less about E3 until they move on from it. I feel the same about Sony and the Move.
Blargh. I'm having a hard time getting excited about anything motion related and Sony/Microsoft have done nothing to help with this. All of my experiences have been lackluster thus far.

Did he deserve to be banned? Sure. Do I think ToS's are overpowered and silly? Absolutely. I'm straddling the fence of ambivalence on the this one.
In terms of brick and mortar references I would say it equates to the banning from the store and a void on all the warranties of the goods he purchased from said store. Of course, there's an identical store right across a street that will gladly resell him the exact same goods.
