I'm sorry but I've read all three linked articles and I can't find where it says the case was filed before 2008. I've found no other mentions of this lawsuit and no mention of a conclusion/settlement.

All of your links point to 2008 as the date of the lawsuit, the extended warranty was created in July 2007. Given that still leaves a full year ofpeople without access to a warranty, microsoft did extend the warranty without any current threats of legal action at the time.

Wrong. Missinformation, The 3 year warranty was solely Microsofts attempt at good faith. They did it without a mandated court order.

Yeah I agree completely, I wouldn't even mind if they scrapped the entire story in Dragon's Dogma, the gameplay and mechanics were on point. All they really need to do is get a decent(better) story, flesh out the quest system a little more, and (imo) tweek the pawn/companion system a bit and it'd be perfect.
