VW has full control over whether their cars meet their own specs and mandatory US emissions regulations. They knew that their cars didn’t meet the regulations and sold them anyway. That means they’re on the hook for the consequences of those choices.

No, but they sure are obligated to sell you a car that lives up to its’ advertised specifications. When they don't, suing for the resulting diminished value of the car is totally legit, because you're not getting what you paid for.

Speaking as a former dealership service manager - this is not a problem that can be addressed at the dealership level without a fix at corporate first. Dealers can’t just hand out new cars on demand, or re-engineer the cars themselves.

Would you care to back that up with facts? The affected VW 2.0TDi models pollute like tractor trailers, from what I've read.
