There are issues with passive silence though. If you are answering questions and someone asks if you murdered someone, your silence at that point may be used

There's a difference between exercising the right to remain silent, and actively interfering with an investigation. Basically, you can passively refuse to cooperate, but you can't deny the police access to evidence.
