Courts have already addressed that defense numerous times. The legal theory allowing prosecution is that you presumably started out sober and intentionally chose to make yourself intoxicated.

Other than Justice Scalia, no one believed Lawrence v. Texas legalized incest. The policy arguments for criminalizing incest (even adult-onset incest) are a lot stronger than the arguments for criminalizing homosexual behavior.

Except that the officials aren’t actually forced to resign. They choose to resign to avoid further public humiliation, prosecution, etc. An elected official is generally free to stay in office for the remainder of their term even if they are actually convicted of a crime unless and until they are impeached or recalled.
How has the DNC “exempted” itself from anything? The default appears to be for political parties to not have specific policies dealing with accusations of sexual assault between delegates. The policies need to be created before anything or anyone can be “exempted.”
