In law? This is obviously a case of him protecting himself or someone else from imminent attack, and should be a no-brainer - a decent prosecutor ought to look at this for about five minutes and come to that conclusion.

Legit Answer (because I was curious about this also): In Virginia, Stand your ground can be applied when you or others around you are in immediate danger. Granted, resources that do not reference handguns are scarce, but from the few that I have seen, it can apply as a defense.
