If someone made a mod that intentionally damaged your machine, they might theoretically be charged under cybercrime laws, though I think in practice it would be a difficult case to pursue and win.

Also, just because damages did not occur does not mean it is justified nor even allowable. If a mod, as means to protect against a pirated game, say... messed around with registries and caused damage to a computer, what would you say then?

Without consideration, a EULA is not a legally binding contract. And setting that aside, the person was never intended to see the EULA in the first place - it’s the equivalent of signing a copy of a physical contract intended for someone else that they photocopied and handed to you to sign.

If the user in question did not give Square Enix money, then no contract exists between that user and Square Enix. There is no contract to be interjected into.

Nonsense. All sorts of private businesses grant or deny service based on ratings/certifications/authorizations by other private organizations. The original licensor doesn’t have to give permission for others to use the presence or absence of that contract as a prerequisite for their own services.
