I'm normally a pretty mellow person but I had a Versa as a rental while my DD was in the shop; it was the most horrible car driving experience of my life. So bad that I actually started screaming at the Hertz rental guy.
+1 diesel regs are super strict in the US. Everything runs SCR and is incredibly clean.
GM takes horsepower battles pretty seriously. I have no doubt that the ATS-V will make more power than their BMW counterpart.
5th Gear: this is the thing that people tend to forget when it comes to Detroit. All (well, many) of those tooling suppliers (tier 2 and 3) are also in the Detroit area. You are absolutely right to question the situation. In my hypothetical situation, I would fully expect to be brought to court. I'm not a lawyer, nor am I on this case (nor would I want to be) so I will let the courts decide involvement.

Not necessarily according to the law. If a pair of criminals break into my house and I shoot and kill one of them (justified under castle law) and the other gets away. The escaping criminal will be charged with his buddy's murder even though I pulled the trigger.
