Oh absolutely, I completely agree! Which is why I stressed the legal or contractual duty; not the moral or ethical duty to do the right thing. Unfortunately there’s no law against being a crappy person.

As I said, law varies from state to state. Yes, a DA can bring criminal charges but it is not the norm. Again - as I wrote in other responses - this case depends on the specific facts and the applicable state law.

It would depend - again, if the producer had a duty of care. Serving liquor as a bartender (and in some states, adults who serve alcohol socially in their home) can rise to liability for harm caused due to a statutorily established duty of care.
