It’s about two private parties setting and agreeing to terms. That’s protected by extended interpretations of free speech. None of what they’re doing challenges free speech, which itself makes it innately protected by free speech. They’re a platform protected by it, even if they don’t embody it.

Though there is an irony: XBOX live is a free-speech platform because all American platforms must naturally allow for it. Part of free speech is defining speech within your own realm/power/property. Though perhaps there’s a distinction better made between Free Speech and free speech.
By federal law all people under 18 are considered minors for pornographic reasons. States have set their own ages of consent but the reach of the internet and other materials is interstate, and that’s federal territory.
