I did some more digging, and that’s from an executive order that Obama signed. Based on the statements in the CREW complaint (they have two anonymous diplomats go “Yeah. I’m staying at Trump Tower because it’s Trump’s”), I think it would be much easier for a swanky hotel to bring suit than CREW.
