Some of the jets out there are amazing. I would never trust my self at the sticks with that much money in the air. I hate to add a serious note to this but I think the FAA likes them. They actually like just about anything that flies. It keeps them in business. They just care about having a bit of order to it

So this is were I currently like how the FAA handles airspace. They have set up areas that you are able to fly and not fly. Generally the not fly areas are there for a reason and tend to make sense. So I do understand that we need some rules, but I think the best way I can address your question is with the answer

You are very right. There are a lot of what if's and living by "what if" is a crappy way to live because we all end up doing nothing. You should do a little research on FAA airspace regulations. Mostly take a look at airspace classified as G and E. I am not a fan of not answering question and just leaving holes so here is a few links to help you understand US airspace and what areas are free to be used by just about anyone and what areas are not.
