I don't have access to the US android market, but I'd be surprised if they didn't update to at least 4.2.2 the moment you turn it on. That's what my Nexus 4 came with about a month ago.

No, the solution for getting updates for the Google Android OS, is to get a device from Google. Not very much unlike how it is if you want a device with iOS. You buy it from Apple. Only difference is, with Android, you have the option of buying a device that is not supported by the original OS distributor.
