At the end of the day, the PIC always has the last word... He can give the middle finger to any direction given by ATC and take any action that he deems necessary to safely operate the aircraft.

I really don't want to take sides here, but I think the point is that they did in fact not try to save him, and he only survived by pure luck because they pulled the car out of the river.
