Not really, I can also reach the left shoulder button while holding the left stick just as easily. His hands would have to be approximately one quarter the size of mine for it to be difficult, and that would mean he has freakishly tiny hands. :p
I don't get it. Unless movement is the right thumbstick, which would be retarded, I don't see a problem... Pressing any of the face buttons with my thumb while holding the right shoulder button is easy peasy on my PSP, and the Vita isn't really that huge of a difference... :s

Honestly, what are the chances that you would have any reason to sue sony or join a class action lawsuit against them? Not to mention that any type of legal action against sony for a ~$300 entertainment purchase would be fucking frivolous anyway, unless it was a health issue in which case I very much doubt this waiver…
