Here's the thing with this case. As a father of 3, yeah, I can see and justify (temporary insanity) shooting this drunk 20 year old dead on the spot if he just ran over my 2 kids. But it sounds like he went home, got his gun, came back, and then shot him. That's a lot more difficult to just ignore.
