I’d argue that a human would have at least tried to brake/swerve and perhaps mitigated it a bit. Likely the result would have been the same, but the fact that the AV did nothing whatsoever is the issue.

I agree if we’re talking an in the wild AV vehicle. But this is a test vehicle. The whole point of a safety driver is to pay attention during the testing period.
For that matter, I’m less inclined to blame the “safety driver” herself. Being inattentive behind the wheel of an AV is sort of the point. This car is driving so you don’t have to.
