The MLB can’t copyright a baseball bat (its too vague of a concept to copyright), but they can say you can’t publicly broadcast a MLB game without their consent. Consent involves paying some sort of fee with some sort of legal restrictions to boot since the game is copyrighted.

When you buy a video game you’re only buying it for personal use.
