Two problems with that:
1. They’re asking for donations, not payment. They are not exchanging goods for services. The download is public - no money need ever exchange hands. So it’s quite a bit different than promoting a company’s services, as they are not selling anything.

A show is good or not on its own, not based on its popularity. Netflix doesn’t want or need to release the data. That doesn’t mean it “forfeited” the right to complain if some else is claiming to have such data and that data is wrong.
