E91 M-Sport owner here. I still lament that I couldn’t (or wasn’t patient enough to) find a manual, but otherwise it’s a damn-near perfect engine. The last of the NA I6 wagons is a beautiful thing.
From my scary college days when I would pull near-all-nighters in the lab and then try to drive home 20 miles on a quiet freeway at 3am, I can attest that it is entirely possible to fall asleep with your hands on the wheel.
Given that in some jurisdictions, merely being in the car with keys “reasonably accessible”, with the engine off*, is still considered a DUI, I doubt this will fly.
A reminder that it is standard practice for officers of the court to avoid stating, as direct fact, *anything* that hasn’t been conclusively proven by direct evidence or a legal finding.
