I suspect that the “gauge” in question is a piece of PVC pipe duct-taped to the hood. If the duct tape holds, it’s “acceptable”. If not, then you have bigger problems.
I’m guessing you don’t understand how much power the NHTSA has over manufacturers. If it’s not safe (by their standards), then it’s not getting sold.

Even going from southern California (i.e. where I am) to northern California, there are some surprisingly large cultural differences.
