I remember reading about this when I was in college. During heavy cram sessions, I would take 20 minute naps every 1-2 hours or so. It really felt like it helped.

It's only tampering with evidence if he encrypted it after the lawsuit was filed. People encrypt their hard drives all the time.
But there's a small loophole to this. In most cases, people aren't releasing modified firmware, but rather, they're releasing tools so that users can modify firmware. You usually download the official firmware and the patcher separately, patch it yourself, then upload it to your PS3.
He seems like the kind of guy who would encrypt his hard drive. What awesome irony would it be if Sony had to break the encryption to get to his stuff?
I honestly don't see what the problem with profanity is. I mean, my only issue with kids learning words like shit and fuck is that it stifles their creativity to come up with harsher, more creative burns.
