I was thinking of criminal negligence, not civil, so I concede the point. Although even then I wonder "what is expected of a reasonably prudent child of that age". Unless the child fired with a formed intention, it may be difficult to prove they knew with "substantial certainty" what was going to happen.

I think the ruling is wrong, but only because the government can display a compelling, competing interest that overrides the real religious freedom enjoyed by anybody, including those who receive some benefit such as licensing by the government.
It's mostly not a rational, direct thing. Why do so many women love broad shoulders and deep voices? They are secondary sex characteristics.
