I assume that at every level of appeal where they try to present new evidence (put either or both of those last two words in scare quotes if you want) the first question from the judge is going to be “Why didn’t you present this evidence during your previous go-round?”

If there is a strategy it is that they intentionally want to get thrown out of every court. That makes them seem like the victims of the deep state courts which they can turn around and use to beg money from the MAGA crowd on the pretense of fighting the system on their behalf. Otherwise, I just can’t understand it.

I mean, that’s the fundamental basis for our justice system, someone may bring a claim, and the claim is then evaluated and continued, thrown out, or upheld.

That’s... That’s not how the legal system even works. You appeal, you’re basically making the case again to a new judge with the evidence you originally had. Getting to the SCOTUS with the bullshit you pulled in the lower courts is going to have that court laugh you out of existence or not even take the case. I look

The running theory in MAGA World is that Trump’s legal team doesn’t have to show any of their evidence right now because all the lower court judges are biased Deep State operatives. Giuliani et al. are just going to unveil everything when they get to the Supreme Court and Trump will then win.

I saw her live on Fox the first time she made those claims. Her tone was even, measured and she appeared to understand the gravity of her accusations. I looked up her bio and she looks legit on paper.
