To be clear, Ultracade machines don't run MAME, and all of the games on the machine are fully licensed. The issue was that Foley kept selling Ultracade software after he'd sold the rights to that software to Global VR.

I would think that fraudulent claims like this would be thrown out based on how the company itself admits that they are aware there is no likeness. Therefore, any of these claims being used as evidence of "protecting our IP" would become void.

Actually it's a problem with the legal system. If faced with a real copy cat the defence can strike a serious blow to their case by pointing out that they haven't been defending their trademark. Companies are actually forced by the shitty legal system to make these frivolous claims or risk losing their mark and
