How is the First Amendment implicated here? They are not being sent to jail. No one is suing them. No government entity is looking to punish them.

Depends on the size of the building. Across that very street, at Tokyo Leisure Land 2, which is inside the black Don Quijote building, there is a massive freight elevator in the back.
