However if this same scenario took place with a human driver striking the victim crossing the street at night, not at an intersection or crosswalk, the driver would not be charged. This is correct. I was unable to negotiate any discount with a used dealer who had the only car within 50 miles. It has been on his lot for 2 months. Instead I walked away and purchased new. Negotiated $10,000 of the MSRP.
