Way I understand it, there has to be damage in principle for libel to stick, but it’s so easy to come up with damages that as you say, its only mitigating in practice.

There certainly are better defenses, but this one is great at its purpose, which is to slap an obvious attempt to intimidate the press rather than a good faith approach to resolve a problem. It’s sweeter because it does have a legal basis (even if, as you say, is very hard to uphold).
