Challenging the legality of retroactive licensing would be an undue burden on smaller companies, you’re right.  At least the EFF is following the case.  They may be able to collect enough funds from the injured parties to mount a legal challenge, should that become necessary.

It’s about the same as with filming: it’s already happened. Productions seek out places with government grants, tax credits, etc… The cheaper the better.

They should absolutely do it. They’re being treated as interchangeable cogs as their employers profit from ignoring labour laws.  This is the problem collective bargaining is intended to fix.
