No, they can’t just take any mutant character, make them not a mutant and reclaim the rights. Quicksilver and Scarlet Witch were ruled to be exceptions, because of their long legacy as Avengers. There will be very few other exceptions like them. I know Kingpin was one, split between Daredevil and Spider-Man.
