Yeah. He sided with the majority there. But the DOMA dissent is the height of hypocrisy, especially considering what they did to the VRA yesterday.

It's especially infuriating that Scalia's dissent in DOMA was a long rant about how the court was overreaching its authority when just yesterday he sided with the court in overreaching its authority with regard to the VRA.

Well, he was mad enough about the DOMA decision for two cases.
They didn't strike down Prop 8. They said the plaintiff didn't have standing to appeal the lower court decision, which means the lower court's opinion stands. Same end result, but not as broad as it should have been.

I didn't mean to imply that I think it would be a good thing. And I agree. The sad fact is that people would find another reason for not getting what they wanted that didn't involve them admitting they weren't qualified.
I've often thought that doing away with affirmative action in hiring and admissions would mean there would be an awful lot of people who would have to find a new reason why they didn't get the job they wanted/into the school they wanted.

I said this in response to another post, but the Dems have to use this decision as a club against Republicans from now til election day 2014. It could be a big motivational issue for an off-year election.
