PS3 updates can be scheduled to occur automatically while the system is in standby.

1) The US government doesn't have the resources to individually look into 314 million citizen's daily email, text, browsing habits, search history, phone calls, etc. It would be naive, and potential paranoia, to believe they're looking into you if you're doing nothing wrong. If they did, they'd be clearing your name.
