Here in Colorado as we have DWAI (Driving while ability impaired) and DUI. DWAI is a "lesser" offense and has a BAC limit of 0.05 vs 0.08 for DUI. The reality here seems to be that both crimes are punished in a similar fashion so you are screwed even if you are well below the 0.08 limit.
