Would they be tried together, or separately? Can you be sure Dzhokhar killed anyone? Injuring others won't get you the death penalty. Are you positive he shot and killed the cop, or was it Tamerlan? Detonating a bomb in a residential neighborhood won't get you the death penalty.

I say this without knowing positively how many people "his" bomb killed. Whether he (or his brother) killed the officer. Tamerlan would be given death going off of what I know.
