As I understand it, SMS messages piggy-back on the link that cellphones use to stay connected to the cell towers. So, they're not doing anything that they wouldn't already be doing.
They said, specifically, that you can get past the activation screens.... but it won't activate.... So, you have access to use it as an iPod Touch.....
