My guess is he'd have no right to do that. Every developer's IPs would be compromised by having DRM free versions of their game out in the wild, and considering that would then be a world without Steam, I'd say that's a scary proposition for devs.

There is no way 20gb of content was not ready for launch. In no game development world does that make sense. These will be levels and art assets that were completed months ago. This is a cost-cutting measure to save on including a second disc.

This isn't a day one patch - this is cost-cutting to save on having to print another disc. How about providing 2 blu rays instead of users having to download 20gb of content?
