In addition to what ptotheedge wrote, the "right to free speech" only applies to the government. The government can't restrict what you say.

Please see post above. Banks is not "covered by free speech" because he was creating a hostile work environment for a specific group, which is not tolerated by federal law. He can be a bigot on his own time, not at work.

The first amendment states that the government has no right to limit or censor a person's speech.

"Freedom of speech" isn't "freedom from repercussions". He wasn't fired for breaking the law, he was fired for violating company policy which is often punishable by termination of employment.
