The key language is “should.” This is in the Flag Code, but is not binding or enforceable. Since it uses “should,” it is permissive (as opposed to “shall,” which would be mandatory.)

I’m an attorney, and for most people, “vindication” isn’t something they can afford to fight for. When the State is out to get you for something (as was the case here), anything less than years in jail is considered a win for a defense attorney.

This is a dangerously false idea. It’s not even close.
