OK, but let’s suppose that members of protected class A statistically commit more murders than members of other classes. In that case, a law punishing murderers would disproportionately affect members of protected class A.

No lawyer “knows the law.” Good lord. The law involves every aspect of society. No one knows all of it. If we are lucky we have a solid grasp on a tiny sliver of it. No reason why a criminal prosecutor would be expected to know anything about government employee law.
