They don't have to convince me or you, they have to convince a judge or a jury who likely know far less about the subject.

In the world of Nintendo lawyers, having the ability to say, "there are striking visual similarities to Mario" is good enough.
I read this as, "Oh shit, I'm REALLY getting attention for stealing artwork and I know how Nintendo is about their IP. I'm hopefully going to cash out before they come after me."
Then, "It is not anything related to legal issues. I just cannot keep it anymore."
"I've received cease and desist letters threatening to sue…
Ad hominem is when you focus on an attack on the person, instead of the rhetorical stance provided. If you're going to lecture on what it means, please be accurate.
"You can't stand someone using what you jsut used."
People can't "just use them" as I don't use them. You're really running out of the ability to be articulate here, resorting to being ad hominem in your rhetoric. I explained both why I don't like to use them, and why I don't like their use in general, but you want to…
I simply avoid adding people who I don't care about what they have to say, and avoid all of that extra work later.
Does it matter what it's referring to? Yes. As per my original reply, it's when people have used it so much that everyone gets the meme, and anyone can use them in the proper context that you see them get over used. Hence my initial reply that I dislike this particular meme because it's so over used.

"It's only when it's widely understood it can even become a meme."
You really think all of the kids posting on forums like this, or reddit have any idea of what the memes are referring to when using them? You're giving people far too much credit.
Unfortunately, while completely well reasoned, I don't expect 99% of the people who use the meme to use it altruistically. For most it's simply a popular satirical meme that will fade away eventually when one that's more topical and new comes about.
There's a clear shot of a giant axe wound to the snake's head pretty early on. Any movement is just muscle response.
For me it has nothing to do with politics and is purely based on the over use of the meme.
I'll provide the same response I gave to someone else. Why add someone as a friend if you're simply going to ignore them. I have LinkedIn and other professional networking sites for coworkers. I have no intentions of providing people a pretense regarding my relationship with them that doesn't exist.
No, well used and creative memes aren't inherently overused. It's when the populace at large begins to understand their reference that they become old and overused.
It's not that I hate all memes, some of them are just far too played out. Luckily I don't frequent sites that use the doge one very often. It for the most part seems decently contained here.
Precisely.
No, I'd hear people "singing" it. Which doesn't mean they know the words, which is the point I articulated here. Please keep up.
I know not of whom you speak. (Especially if he hosts other E! shows as you mentioned) Actually, I should admit that I do believe I've seen the soup once; or at least part of it, and mistook it for Tosh.0, then changed the channel regardless.
"Over everything in the world!" =P
Seen it, it's still old and played out. Much like replying with the meme that someone says that don't like. Both show a lack of creativity =)
