The first amendment is a legal enforcement of the idea that one has the right to free speech. It is not literally the right to free speech itself. Free speech is an ideal, not just a right that exists solely within the concept of American law.

“People of color” doesn’t mean black. It means any racial minority. So it should be compared to the proportion of non-white people in whatever population you decide to compare it to.
