Fair enough! I'm hoping they can make a persuasive argument that, while they're still legally liable for the gross invasion of this woman's privacy, changes to their EMR security wouldn't have prevented it - so responsible clinicians (like you!) don't have to lose even more of the access they need. But we shall see....
I'm sure they already got this talk! They definitely deserve to be punished - harshly. I'm not sure anyone would have been able to scare them out if this ridiculous idea, though!
I do EMR for a living - I know what a hassle it is to sort out security and that oftentimes you can't get to what you need (a huge, shitty hassle)! :(
Exactly - they already went through HIPAA training, they already knew this was a firable offense, they just did it anyway! This woman deserves some cash absolutely, but I don't think there are a lot if practical, measurable policy changes that could prevent this from happening in the future.
I agree that she should sue, my concern is with the idea that this could have been prevented by some sort of "protections." These people are already going through screening and HIPAA training - besides doubling down there (probably a good idea!) I don't know that there's a lot they can do.
