I think a lot of it has to do with the fact that people generally mix up the three main types of IP rights (patent, trademark, and copyright) and don’t really understand what a trademark application/registration means. It’s a far more limited thing that most people seem to think.

She’s a smart business woman. How does that make her an asshole? Also, I’m sure her attorneys are the ones coming up with these trademark ideas because, you know, that’s their job.

A Trademark registration doesn’t mean no one else can use a term period, it has to do with use in commerce in connection with the goods and services she applied for (here, roughly, paper products, clothes, retail services, and entertainment services). And even then, you still have fair use exceptions.
