Not possible considering they had to turbo a 3.0 h6 to pass emissions. The basic concept of the engine, quad turbo flat plane crank, already exists and passes emissions in the veyron. Scaling that displacement down is fairly easy

They had spent millions developing the engine and chassis for a race series that was killed before the car was done. PAG was barely treading water and needed to recoup costs.
I totally get compensation for someone who decided to trade in their TDI after dieselgate happened. but I dont think someone should get any money from VW if they traded their TDI in 3 years ago after putting 150k+ on it :)
