While Nintendo finished 3rd with the Gamecube, they made money. Microsoft on the other hand might have sold more XBox systems, but they lost a ton of money. They only stayed in the business out of pure pride and stubbornness! More recently however, it seems that strategy has paid off.
They've gone on record before to say that while they don't condone copyright infringement with things like mods or fangames, they don't really want to punish their biggest and most passionate fans for being fans, so they kind of tend to take these things on a case by case basis.
I think post SNES showed signs of Nintendo losing track where hardware was concerned.
