What’re you having trouble with? The game has more of a built in slider than most of the older titles with just the ashes of war and summons alone. A lot of variables depending on state and insurance regulations really but technically the car was in the shops care custody and control so they are legally liable. Now whether it's easier to file through his insurance or not is an altogether different matter.
