Given how extreme this case is, I see no way out of the death penalty, no matter how someone wants to spin it. Even if he were formally declared as mentally ill down the line, now that they can proceed, he has killed too many people. At the very least, I see no reason he shouldn’t.

This is what happens when you have to find a nominal plaintiff, though. You find one who fits a certain profile because it’s a legal strategy. There is never a promise of payment (and there clearly wasn’t in this case or someone would have pointed that out) to the plaintiff when money isn’t involved.
